VII. PENALITIES:

Low Hazard Noncompliance: Any Member of HWW’s water system found to be in
noncompliance with the requirements of this policy will be so notified in writing.
With the exception of annual BFP inspections, testing, repair or replacement, HWW
will provide a courtesy notice of noncompliance, and a compliance grace period
appropriate under the circumstances of noncompliance, but not exceeding ten (10)
days. Failure to comply could result in discontinued service and/or meter being
removed in addition to fines, and a substantial meter reinstallation fee. Any
fines/fees incurred after HWW water bills are generated will be added to the
customer’s account after the 15 th of the following month to avoid incurring late fees.

  • 1.Fines and Fees.
    The following fines and fees will be applied in the following circumstances. Fines are cumulative:
    A. Inspection and testing violations for 5/8” x ¾” meter services, as evidenced by nonreceipt of certification by HWW;
    1. Notice Letter for failure to inspect annually……$15
    2. Failure to certify ten (10) days after Notice Letter….$75
    3. Failure to certify, each additional day after fifteen (15)
      days from Notice Letter….$25
    4. Failure to certify, 30 days after Notice
      Letter—Disconnection and removal of meter. A $250
      inspection and reinstallation fee shall be charged upon
      compliance.
  • B. Inspection and testing violations for 1” – 3” meter services, as evidenced by nonreceipt of certification by HWW:
    1. Notice Letter for failure to inspect annually……$25
    2. Failure to certify ten (10) days after Notice Letter if repairs or
      replacement are NOT required….$150
    3. Failure to certify, each additional day after fifteen (15)
      days from Notice Letter if repairs or replacement are NOT
      required…..$30
    4. Failure to certify, thirty (30) days after Notice Letter if
      repairs or replacement ARE required…..$300
    5. Failure to certify, each additional day after 30 days from Notice
      Letter if repairs or replacement ARE required…..$30
    6. Failure to certify, 46 days after Notice
      Letter—Disconnection and removal of meter. A $300
      inspection and reinstallation fee shall be charged upon
      compliance.
  • C. Inspection and testing violations for meter services larger than 3”, as
    evidence by nonreceipt of certification by HWW:
    1. Notice Letter for failure to inspect annually……$100
    2. Failure to certify fifteen days after Notice Letter if repairs or
      replacement are NOT required….$100
    3. Failure to certify, 30 days after Notice Letter if repairs or
      replacement ARE required…..$250
    4. Failure to certify, each additional day after 40 days from
      Notice Letter if repairs or replacement ARE required…..$50
    5. Failure to certify, 45 days after Notice Letter—Disconnection
      and removal of meter. A $500 inspection and reinstallation fee
      shall be charged upon compliance

Fines for BFPs requiring repairs or replacement may be reduced in HWW’s sole discretion if substantial evidence is provided that the member acted in good faith in diligent pursuit of repair or replacement, but parts or replacement BFP were not reasonably available in timely manner. Late or delayed commencement of initial test or ordering of parts or BFP are evidence of lack of diligence.

  • D. Failure to have inspection punch card on BFP, after thirty (30) day notice letter:
    1. Failure to install card after 30 days…$25
    2. Failure to install card after 60 days…$50
    3. 90 days after notice letter—Disconnection and removal
      of meter. A $500 inspection and reinstallation fee shall be
      charged upon compliance.
